CONSTRUCTION DISPUTES

PROPERTY OWNER'S CLAIMS vs. CONTRACTORS

An owner is not bound to a contractor if the contractor does not properly and timely perform its work.  The owner can fire the contractor, hire someone to finish the work, and sue the first contractor for any increase in costs.  When to fire a contractor can be a difficult issue, so consult an attorney first.  

Contractor's Claims vs. Owners:

Making an owner pay is the ultimate frustration for contractors.  Contractors must substantially complete their job before requesting final payment, and the owner can withhold retainage (ten percent) for thirty days after completion in most cases.  A lien may need to be filed if prompt payment is not received. 

Delay claims are also very common.  Defense of these claims requires a systematic examination of the construction to put together a timetable showing how failing to meet the contractual deadline was unavoidable, excusable, or caused by the owner's actions (including change orders).
